A person is guilty of his offense when they threaten to injure a person, their family or their property in such a way that a reasonable person would believe that the threat would actually be carried out. The victim must also believe the threat would actually be carried out. If the threat is clearly a joke or exaggeration, there is no violation. Communicating threats is charged as a Class 1 misdemeanor in North Carolina.


Harassing phone calls can also be charged as a Class 2 misdemeanor in North Carolina. Different facts must be present for a person to be found guilty of this offense.
