A person commits the offense of shoplifting when they conceal merchandise from a store without having purchased the items. The law does not require that the person actually remove the property from the premises. Unlike most theft offenses, the person does not need to permanently deprive the owner of the property. This simply means that the person does not have to plan to take the merchandise home and never return it : concealment of the merchandise is the crime.
This offense is filed as a misdemeanor. It is possible that a person accused of this crime will be given the option to attend and complete a court designated program lasting a few weeks. After successful completion of this class, the case can be dismissed. An attorney can assist you in getting the opportunity to attend the program.
